Commercial Litigation Involving First Nations' Commercial Activities

First Nations' commercial activities are governed by The Indian Act: legislation that affords natives and reservations certain rights and protections but, in doing so, also imposes significant restrictions on their capacity to conduct business in Canada. Specifically, the impact of Sections 87 and 89 of The Indian Act on native commercial activities has been such that the legislation will most certainly face significant challenges to its continued application.

Our commercial litigation department has assumed carriage of a file in which the court's decision may well have significant ramifications for the future of Section 89 of the Act and aboriginal rights.
